PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of CERTIORARIFIED MANDAMUS, calling for the records relating to the proceedings of the 3rd respondent in Na.Ka.No.374/2023/A1 dated 26.06.2025, quash the same as illegal, arbitrary and unsustainable in law, and consequently direct the respondents to consider the petitioner's representation dated 26.11.2025 and appoint the petitioner's son to any suitable post based on his educational qualification in Arulmigu Kalyana Venkataramana Swami Temple, Thanthonrimalai, Karur District, upon relieving the petitioner from her temporary appointment with in a time frame fixed by this Court. The petitioner's husband, who served in Arulmigu Kalyana Venkataramana Swamy Temple, Karur District died on 05.01.2023. This petitioner has submitted an application seeking an appointment on compassionate ground on 04.07.2023 and the same was considered and she was also appointed as a Cook in the said 2/6
temple, under the scale of pay Level 6 (6900-21500). The petitioner is also working as Cook for the past two years. While so, the petitioner has submitted another application seeking an appointment on compassionate ground for her son and it was rejected by the Executive Officer, Arulmigu Kalyana Venkatramanaswamy Temple, Karur in his proceedings in Na.Ka.No.374/2023/A1, dated 26.06.2025. Challenging the same, the petitioner has approached this Court.
2.Mr.J.K.Jeyaseelan, learned Government Advocate takes notice for the respondents 1 & 2. Mr.P.Athimoola Pandian, learned counsel takes notice for R3.
3.Heard the learned counsel on either side.
4.The compassionate appointments are provided in order to provide immediate financial relief to the family of a Government servant, who dies in harness, preventing them from falling into 3/6
sudden destitution. It serves as a social security measure, ensuring that the family can overcome the crisis caused by the loss of the sole breadwinner. It appears that this petitioner's husband, who served in the respondent temple died on 05.01.2023 and the petitioner, being the wife of the employee has been accommodated as Cook on compassionate ground on 08.01.2024. The petitioner is also working as Cook in Arulmigu Kalyana Venkatramanaswamy Temple, Karur, under the scale of pay of 6900-21500. Therefore, the petitioner is not entitled for any further claim of appointment on the ground of compassionate as the concession of compassionate appointment has already been extended to this petitioner.
5.In view of the above, this Court is not inclined to interfere with the impugned order. Accordingly, this writ petition is dismissed. No costs.
