PRAYER :-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondents to take appropriate action to reimburse the medical expenses insurance amount to the tune of Rs.68,249/- with interst to the petitioner for petitioners wife treatment from 16.01.2021 to 19.01.2021 taken in Anbu Multi speciality hospital by considering the petitioners representation dated 14.09.2023 in accordance with law within the time stipulated by this Court.

ORDER
The petitioner has filed this writ petition for a mandamus to direct the respondents to take appropriate action to reimburse the medical expenses insurance amount to the tune of Rs.68,249/- with interest to the petitioner for his wife's treatment from 16.01.2021 to 19.01.2021 taken in Anbu Multi speciality hospital by considering the petitioner's representation dated 14.09.2023 in accordance with law within the time stipulated by this Court.

2. Heard the learned counsel for the petitioner, the learned Additional Government Pleader for the respondents 1 to 3 and the learned standing counsel for the 4th respondent.
3. The petitioner is a retired Government servant and a beneficiary under NHIS. During 2021, his wife was affected with COVID-19 and hence, she took treatment from Anbu Multispeciality Hospitals, from 16.01.2021 to 19.01.2021 by incurring a sum of Rs.68,249/-. When the petitioner approached the respondents for medical reimbursement by way of representation dated 14.09.2023, the same was not considered and hence, the petitioner is before this court with this writ petition.

The learned counsel for the petitioner submitted that the District Level Empowered Committee has made a recommendation for medical reimbursement as early as on 04.03.2022, but, so far, the 4th respondent has not considered the claim of the petitioner in tune with the recommendation made by the District Level Empowered Committee and release the medical reimbursement.

In view of the above, the writ petition is allowed by directing the 4th respondent to release the medical reimbursement due to the petitioner in accordance with the recommendation, if any made by the District Level Empowered Committee or pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
