ORDER

Heard the learned counsel on either side.

2.The petitioner seeks issuance of passport. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the second respondent submitted that a case has been registered against the petitioner. Final report has already been filed against the petitioner and it has been taken cognizance in C.C.No.53 of 2021 on the file of the learned Judicial Magistrate, Avinashi. There is now proposal to transfer the case to the Special Court for Anti Land Grabbing cases.

3.Be that as it may, the petitioner is permitted to file an miscellaneous petition before the learned Judicial Magistrate, Avinashi seeking the relief now sought for before this Court. The learned Trial Judge is directed to dispose of the petitioner's application on merits and in accordance with law within a period of three weeks after it is filed. With this liberty to the writ petitioner and direction to the jurisdictional trial Magistrate, this writ petition is disposed of. There shall be no order as to costs.
