ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to survey the petitioner's property comprised in Survey No.1066/3C, to an extent of 381⁄2 cents, and Survey No.1066/3D, to an extent of 47 cents, situated at Mahathanapuram South Village, Krishnarayapuram Taluk, Karur District, and to demarcate the four boundaries thereof, and consequently, to direct the third respondent to provide adequate police protection for conducting the said survey by considering the petitioner's representation dated 25.04.2025, within the time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.

The learned counsel appearing for the petitioner submits that the petitioner is the absolute owner of the properties in question and that a representation dated 25.04.2025 was made seeking survey and demarcation of the boundaries of the said properties. Since no action has been taken by the first respondent, the present writ petition has been filed.

5. The learned Government Advocate appearing for the respondents 1 and 2 submits that after issuing notice to the adjacent land owners, appropriate steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this writ petition stands disposed of with a direction to the respondents 1 and 2 to consider and dispose of the petitioner's representation dated 25.04.2025 for survey and demarcation on merits and in accordance with law. Notice shall be issued to the petitioner, the fourth respondent and the owners of adjacent lands and appropriate orders shall be

passed in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order. It is needless to state that the revenue officials may seek assistance from the third respondent, if Police assistance is required while carrying out such survey. In the event of any rival claims, the same can be agitated before the competent civil court. No costs. NCC : Yes / No (K.SURENDER, J.)
