RESPONDENT / RESPONDENT IN BOTH THE PETITIONS PRAYER IN CRL MP(MD)No.646/18 IN CRL RC(MD)No.61/18:- Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to SUSPEND THE EXECUTION OF SENTENCE in C.A.No.43 of 2017 dated 07.10.2017 wherein the Honourable Court has confirmed the conviction and sentence imposed by the Learned the Fast Track Magistrate Court, Palani, Dindigul District in C.C.No.77 of 2015 dated 15.02.2017 pending disposal of the above Criminal Revision Petition and thus render justice.
Prayer in CRL MP(MD). 647/ 2018 IN CRL RC(MD)No.61/18 : To EXEMPT the petitioner from surrender in C.A.No.43 of 2017 dated 07.10.2017 wherein the Honourable Additional District Sessions Judge, Palani, Dindigul District has confirmed the confivition and sentence imposed by the Learned Magistrate Court (Fast Track) Palani, Dindigul District in C.C.No.77 of 2015 dated 14.02.2017 pending disposal of the above Criminal Revision Petition and thus render justice.
Order : These petitions coming on for orders upon perusing the petitions filed in support thereof and upon hearing the petitioner and the Respondent not appeared either in person or by an Advocate, the court made the following order:- On 31.01.2018, this Court passed the following order: "If the petitioner deposits the cheque amount and the compensation amount, within two weeks, this Court could consider the exemption application." https://hcservices.ecourts.gov.in/hcservices/
2. The petitioner has not complied with the above extracted
order and therefore, both the Miscellaneous Petitions are dismissed. The trial Court is directed to issue committal warrant to secure the accused for undergoing the sentence. Liberty is given to the accused to file a fresh application for suspension of sentence and bail after he surrenders or he is arrested.
