ORDER

This Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned Refusal Check Slip in Refusal Number RFL/Melapalayam/161/2024 dated 27.11.2024 passed by the Respondent No.3 and consequently directing the Respondent No.3 to register the Sale Deed dated 21.11.2024 presented by the Petitioner. .

It is the case of the petitioner that he has purchased a vacant house site plots situated in Plot Nos.243 & 244 with an extent about 6.02 cents from one M.Natarajan for the sale consideration of Rs.1,31,700/-. The petitioner has paid the entire sale consideration to the vendor and on 21.11.2024 they entered into a sale deed and the same was produced before the 3rd respondent on 27.11.2024. But the 3rd respondent has refused to register the sale deed and issued the impugned refusal check slip stating that there was a double entry regarding the property in respect of the subject property. Whereas it is the contention of the petitioner that the subject properties was purchased by petitioner's vendor on 18.02.2005 through a registered sale deed vide document Nos.688 of 2005 from one Paramasivam @ P.P.Sivam who is the power agent of one George 2/5

and 5 others, right from the purchase, the petitioner's vendor was having peaceful possession and enjoyment of the property. Therefore, according to the petitioner, he has title over the said property.

3. Heard both sides and perused the materials available on record.

4. At the outset, the petitioner has purchased the subject property from the original owner. Merely because there is a double entry in respect of subject property, the registration cannot be refused.

5. Accordingly, this writ petition is disposed off and the impugned refusal slip dated 27.11.2024 passed by the 3rd respondent is hereby quashed. The third respondent is directed to register the petition mentioned document within a week from the date of receipt of a copy of this order.
