Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing to issue a Writ of Mandamus, directing the respondents herein to implement the 14th wage settlement (ghh;it C1/23053 of 2019) signed under Section 12(3) of the I.D.Act dated 24.08.2022 and to re-calculate the retirement benefits of the petitioner such as difference amount of gratuity, leave salary, provident fund, commuted value of pension, revised pension for the period from 01.09.2019 to 31.05.2022 (date of retirement) pension arrears and other retirement benefits and consequently direct the respondents to pay the petitioner the difference amount of the same along with interest at the rate of 6% per annum within the time limit stipulated by this Court. ORDER
The petitioner joined the service of the respondent Transport Corporation on 30.04.1993 and after rendering 29 years of service, he retired from service on 31.05.2022. A tripartite wage settlement under Section 12(3) of the Industrial Disputes Act was entered into between the Management and Trade Unions on 24.08.2022. As per the terms of 2/5
settlement, the Management has agreed to revise the wages of the employees who were in service as on 01.09.2019 by revising the pay with effect from 01.09.2019 notionally and monetary benefits with effect from 01.01.2022.
2. The petitioner was in service as on 01.09.2019 and therefore, the petitioner made a representation dated 16.12.2025 to the respondent seeking the benefits due to him as per the wage settlement. Alleging inaction, he has filed this writ petition seeking a mandamus to the respondents to revise his wages, based on the wage settlement dated 24.08.2022 and to pay the benefits with interest.
3. The learned standing counsel appearing for the respondent Corporation submits that they would consider the request of the petitioner and pass orders on merits.
4. Considering the prayer sought for this in this writ petition, the respondents are directed to pass orders on the representation of the petitioner dated 16.12.2025 on merits and in accordance with law, within 3/5
a period of four weeks from the date of receipt of a copy of this order. This writ petition is disposed of accordingly. There shall be no order as to costs.
