ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 49, 191(2), 191(3) & 103(1) of BNS Act 2023 @ into sections 61(2), 49, 191(2), 191(3) & 103(2) of BNS Act, seeks anticipatory bail. 1/4

2. The case of the prosecution is that, due to previous enmity, the accused persons brutally attacked the defacto complainant's son with a deadly weapon like an aruval all over his body, and due to the grievous injuries, he died. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and is in no way connected with the alleged occurrence as stated by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police opposed the grant of anticipatory bail to the petitioner and submitted that some of the persons involved in the crime are on bail and others are in judicial custody. The specific overt act alleged against the petitioner is that he was also involved in the crime, and there is evidence that he was in contact with the persons involved in the murder both before and after the crime.

5. The learned counsel appearing for the intervenor submitted that a petition has been filed before the Principal District and Sessions Court, Sivagangai, seeking protection for the witness, and the same is pending.

6. Taking all these facts into consideration, and since it is a case of murder, this Court is not inclined to entertain this petition.

7. Accordingly, this Criminal Original Petition stands dismissed. The learned Principal District and Sessions Judge, Sivagangai, is directed to consider the protection petition and pass appropriate orders, forthwith. 10.02.2026 KSA 3/4
