ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A) and 506
(2) IPC and Sections 3, 4 and 5 of Dowry Prohibition Act and Section 4 of Tamilnadu Prohibition of Harassment of Women Act in Crime No.20 of 2015 and hence, seek anticipatory bail.
2.It is alleged that the petitioners have harassed the defacto complainant and demanded dowry.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence. It is further submitted that the defacto complainant is not willing for re-union and she refused to live with the first petitioner.
4. The Government Advocate (Crl. Side) appearing for the State submitted that the petitioners have demanded Rs.5 1⁄2 lakhs and 5 cents of land.
5. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.III, Kanyakumari, and on each of them executing a separate bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction to the learned Magistrate concerned and on further condition that the first petitioner shall appear before the respondent police at 10.00 a.m until further orders and the petitioners https://hcservices.ecourts.gov.in/hcservices/
2 and 3 shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.
