ORDER

This petition has been filed to direct the first respondent police to expedite the investigation in FIR No.04/AC/2021 and file a final report within the time stipulated by this Court.

2.The case of the prosecution is that the second respondent/accused was working as Executive Officer of Arulmigu Rathinagireeswarar Temple, Ayyarmalai, Kulithalai Taluk, Karur District, during the relevant period between 22.07.2018 and 12.10.2021. During that period, he swindled the money of the temple by creating false records such as vouchers and expenditure bills as if the crackers were purchased, works were executed and wages were paid to the night watchman. Hence, a case has been registered in FIR No.04/AC/2021 for the offences under Sections 409, 465, 468, 471 of IPC and Section 13(2) r/w 13(1)(a) of Prevention of Corruption Act, 1988, against the accused. Since till date the investigation in the above said case is pending, present petition has been filed by the petitioner with the above said prayer.

3. The learned counsel for the petitioner submitted that the case was registered in the year 2021. Even after a lapse of 3 years, there was no 2/4

progress in the investigation and no steps were taken against the second respondent/accused. Hence, he prayed this Court to give a direction to the respondent to expedite the trial and file final report within the stipulated time prescribed by this Court.

4.The learned Additional Public Prosecutor on instructions, submitted that the Investigating Agency after conducting investigation, recommended the case for initiating departmental proceeding under Tamilnadu Civil Services (Disciplinary Proceedings Tribunal) Rules, 1955.
