PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 4th respondent to forthwith conduct the Field Measurement Survey in respect of Survey No.798/6, Old Survey No.347K 2B, Milattur 1st Sethi Village, Papanasam Taluk, Thanjavur District, classified as Ryotwari House Site, Patta No.126, Old Patta No.176, Extent 3.10 Ares, pursuant to Field Measurement Receipt No. 2025/N123/21/009682 dated 08.09.2025, and to issue the FMB sketch and related records by considering the petitioners representation dated 15.11.2025.

O R D E R

The petitioner seeks a direction to carry out survey and demarcate the petitioner's property in respect of Survey No.798/6, Old Survey No. 347K 2B, Milattur 1st Sethi Village, Papanasam Taluk, Thanjavur District, classified as Ryotwari House Site, Patta No.126, Old Patta No. 176, Extent 3.10 Ares, pursuant to Field Measurement Receipt No. 2025/N123/21/009682 dated 08.09.2025 and to issue the FMB sketch and related records by considering the petitioner's representation dated 15.11.2025.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The petitioner complained that the survey and demarcation of his land had not been carried out as per his representation dated 15.11.2025.

4. The learned Government Advocate appearing for the respondents submits that after considering the claims of all parties, proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. In view of the above, this Court directs the fourth respondent to consider and dispose of the petitioner's representation dated 15.11.2025 for survey and demarcation on merits and in accordance with law. Notice shall be issued to the petitioner, the fifth respondent and the owners of relevant adjacent lands and appropriate orders shall be passed in 3/5

accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same can be agitated before the competent civil court.

6. This writ petition stands disposed of on the above terms. No costs.
