RESPONDENT/RESPONDENT /COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to exempt the Petitioners from surrendering pursuant to the sentence imposed by the judgment delivered by the J.M.Ambasamuthiram in CC.No.192 of 2012 vide his judgment dated 13.03.2018 and which was been subsequently confirmed by the III Additional District and Sessions Judge, Tirunelveli in C.A.No.32 of 2018 vide his judgment dated 20.12.2023 pending disposal of the Criminal Revision Petition.

To call for the entire records pertaining to the judgment delivered by the Judicial Magistrate, Ambasamudhiram in CC.No.192 of 2012 vide his judgment dt.13.3.2018 and which has been subsequently confirmed by the III-Additional District and Sessions Judge, Tirunelveli in C.A.No.32 of 2018 vide his judgment dated 20.12.2023 and set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.K.MAHENDRAN, Advocate for the petitioners and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) on behalf of the Respondent, while admitting the Criminal Revision Case, the court made the following order:- The learned counsel for the petitioners would submit that the 1st petitioner was arrested on 12.08.2024, and the 2nd petitioner voluntarily surrendered before the trial Court on 29.10.2024, and both of the accused are in custody till date. 2.Since both the petitioners are already in custody, there is nothing remains to be adjudicated in the present petition.
3.Accordingly, this Criminal Miscellaneous Petition stands dismissed as infructuous.
