Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the fourth respondent to survey the land in S.No.268/2 to an extent of 569.09 Sq.Meter situated in Kavalakurichi Village, Alangulam Taluk, Tenkasi District by demarcating the boundaries with the help of fifth respondent police on the basis of the petitioner's representation dated 30.09.2025. O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the fourth respondent to survey the land in S.No. 268/2, measuring an extent of 569.09 sq. metres, situated in Kavalakurichi Village, Alangulam Taluk, Tenkasi District, by demarcating the boundaries with the assistance of the fifth respondent police, on the basis of the petitioner's representation dated 30.09.2025.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

3. The learned counsel appearing for the petitioner would submit that a representation has been submitted seeking survey of the property in question and demarcation of its boundaries.

4. The learned Special Government Pleader appearing for the first, third and fourth respondents would submit that after consideration of the claims of the parties, proper steps would be taken by the third respondent to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Court directs the third respondent to consider the representation of the petitioner dated 30.09.2025, survey and demarcate the petitioner's land after considering the claims of all parties including the private respondents and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners, the private respondents and other interested parties, Page No. 3 of 6

if any and that if required, police assistance may be taken. If the petitioner has not paid the requisite fee for survey and demarcation, the petitioner shall pay the same within a period of two weeks from the date of receipt of a copy of this order and produce a copy of the receipt to the fourth respondent forthwith.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
