O R D E R

The Criminal Original Petition has been filed for a direction to the learned Juvenile Justice Board, Ramanathapuram to accept the petitioner's surrender and consider the petitioner's bail application on the same day in Crime No.44 of 2015 on the file of the respondent police.

2. The petitioner is arrayed as an accused for offences punishable under Sections 147, 148, 294(b), 323, 324 and 506(ii) 307 IPC in Crime No. 44 of 2015 on the file of the respondent police.

3. The learned counsel appearing for the petitioner submitted that since the petitioner is a juvenile, there is a bar to move the Anticipatory Bail under Section 438 of Cr.P.C., before the Juvenile Justice Board, Ramanathapuram.

4. The submissions made by Mr.A.Uthayakumar, learned counsel for the petitioner and by Mr.K.Anbarasan, learned Government Advocate (Crl. Side) representing the respondent were heard. The materials available on record were also perused.

5. Considering the nature of offences alleged against the petitioner and that taking into custody of the petitioner could cause him irreparable hardship, this Court directs the learned Juvenile Justice Board, Ramanathapuram to consider the bail application of the petitioner to be filed by the petitioner on merits and pass appropriate order on the same day of his surrender.
