Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.A.BANUMATHY, Advocate for the petitioners and of Mr.K.SUYAMBULINGA BHARATHI Government Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed in Cr.O.P(MD)No.4500 of 2009 dated on 27.03.2019. 2.The petitioners were implicated for the offence under Sections 452, 323 and 506 (I) r/w of IPC in Crime No.57 of 2019 and granted anticipatory bail by this Court in Cr.O.P(MD)No.4500 of 2009 dated on 27.03.2019 on one of the condition that the petitioner should open the bank account in the name of the defacto complainant and should deposit a sum of Rs.15,000/- in favour of her and handed over the said bank pass book to her.

https://hcservices.ecourts.gov.in/hcservices/ 3.The learned counsel for the petitioners would submit that the defacto complainant has refused to come to the bank for opening the

new bank account. Accordingly, the petitioners have not been complied the condition imposed by this Court. Further the learned counsel for the petitioners would submit that the petitioners are ready to give Rs.15,000/- in the way of Demand Draft or give cash to the defacto complainant directly in the presence of the respondent police.

4.The learned Government Advocate (Crl.Side) appearing for the respondent has no objection to modify the condition imposed by this Court.

5.In view of the learned counsel for the petitioners as well as the learned Government Advocate (Crl.Side), the condition imposed by this Court is modified as the petitioners shall give a sum of Rs.15,000/- in the way of Demand Draft or give cash to the defacto complainant directly in the presence of respondent police. 6.Accordingly, this petition is ordered.
