PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the proceedings of the 1st respondent in file number TR1075593569725 and quash the same as illegal and direct the 1st respondent to issue a passport to the petitioner based on his application dated 06.10.2025 on the file of the 1st respondent.

ORDER

The present writ petition has been filed seeking to quash the show cause notice issued by the first respondent calling for explanation from the petitioner with regard to the adverse police report.

2. According to the learned Government Advocate(crl.side) appearing for the second respondent, the petitioner has been implicated in a criminal case in Cr.No.326 of 2016 on the file of the second respondent police which has culminated in filing of a charge sheet in C.C.No.120 of 2024 on the file of the learned Judicial Magistrate, Pattukottai.

3. In view of the above said facts, the petitioner is directed to approach the trial Court concerned seeking permission of the Court to go abroad. In case if any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the orders to be passed by the trial Court, the first respondent is directed to proceed in accordance with law. 2/4

4. With the above said observations, this writ petition stands disposed of. No costs.
