For Petitioner : Mr.G.Anto Prince For R1 : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor For R2 : Mr.J.Selvakumaran (in all petitions) COMMON ORDER The petitioners seek to quash the impugned charge sheet in C.C.No.93 of 2023, on the file of the Additional Mahila Court, Nagercoil, Kanyakumari District, which was filed for the offences under Sections 294(b), 406, 498(A) and 506(ii) of IPC and Sections 4, 6 of Dowry Prohibition Act.

2.The first accused is the husband of the defacto complainant. The gist of the allegation is that first accused along with the other accused had committed cruelty in various forms in connection with a dowry demand.

3.When the case was heard earlier, this Court referred the parties to mediation. After the mediation, an agreement was entered into between the parties, by which the defacto complainant/second respondent herein agreed to withdraw the complaint, which culminated in the impugned final report. The report of the mediator along with the settlement agreement entered into between the parties is taken on record. 4.The learned counsel appearing for the defacto complainant confirms the compromise and states that the defacto complainant has agreed to withdraw the complaint which culminated in the impugned final report, with liberty to approach the Family Court for other issues. 5.In view of the compromise arrived at between the parties and in view of the settlement agreement, this Court is inclined to quash the impugned charge sheet. Accordingly, the impugned charge sheet in C.C.No.93 of 2023 on the file of the Additional Mahila Court, Nagercoil, Kanyakumari District, is quashed and the Criminal Original Petitions are allowed. Consequently, connected miscellaneous petitions are closed. 3/5
