O R D E R

This writ petition has been filed challenging the impugned order dated 22.09.2020, passed by the first respondent, rejecting the petitioner's request to be appointed to the post of Junior Training Officer in Fitter category, based on the recruitment notification.

According to the petitioner, the first respondent had failed to see that calling for 11 BC General candidates reveals that the number of vacancies existing in the post of Junior Training Officer (Fitter) is two and therefore, the petitioner's case ought to have been considered for appointment to the said post, as he had scored overall second mark in BC General category, even as per the impugned order passed by the first respondent.

However, as seen from the counter affidavit filed by the second respondent on behalf of the first respondent as well, a categorical statement has been made that there was only one vacancy for the post of Junior Training Officer (Fitter) and that the earlier notification revealing that there were two vacancies for the subject post was reduced to comply with the directions issued by this Court to accommodate the retrenched workmen.

4. Admittedly, the person selected to the post of Junior Training Officer (Fitter) has secured more marks than that of the petitioner. The name of the person selected is T.Chairmandurai, who also belongs to BC Community and has secured 83 marks. Whereas, the petitioner has secured 80.6 marks, which is lesser than that of the said T.Chairmandurai and therefore, the respondents have rightly selected the said T.Chairmandurai to the vacant post for Junior Training Officer (Fitter). Till date, the respondents have also not filled up any additional post to the post of Junior Training Officer (Fitter) and they have also categorically stated in their counter affidavit that there was only one vacancy to the post of Junior Training Officer (Fitter), which was filled up by the said T.Chairmandurai, who had secured more marks than that

of the petitioner. The petitioner is now 59 years as on date and is on the verge of retirement. This Court has also taken note of the said fact as well for dismissing this writ petition both on the ground that the petitioner has secured lesser marks than that of the said T.Chairmandurai, who was selected to the subject post and also on the ground that the petitioner is on the verge of retirement. This Court is not entertaining this writ petition as there is no merit in the same.

5. Accordingly, this writ petition is dismissed. No costs. 18.09.2025 NCC :
