ORDER : The Court Made the following order :- The petitioner who is arrayed as A1, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A), 323, 506(i) and 109 IPC and Section 4 of Dowry Prohibition Act, in Crime No.16 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.The case of the prosecution is that the marriage was solemnized between the petitioner and the de-facto complainant before two and half years and out of the wedlock they are having female child. The allegations against this petitioner and others are demanding dowry of Rs.1,00,000/- and five sovereigns of gold.
3. The learned Counsel appearing for the petitioner submitted that the petitioner is working as a Teacher in a private School at Natham. He has been falsely implicated in this case . He further submits that as per the direction of this Court the petitioner was appeared before the Mediation Centre, however, the de-facto complainant has not appeared before the Mediation on four occasions and hence the mediation could not be conducted.
4. It is submitted by the learned Government Advocate (Crl.side) that the investigation is going on. She further submits that the coaccused enlarged on anticipatory bail before the Sessions Court.
5. Considering the submissions made by the learned Government Advocate (Crl.side), this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
6. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate No.III, Dindigul, Dindigul District, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/
Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. for period of two weeks and thereafter as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
