Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the 1st respondent to transfer the investigation in respect of Cr.No.262/2022 dated 27.05.2022 from the 2nd respondent to the 3rd respondent and further direct the 3rd respondent to complete the investigation and lay charge sheet within stipulated time framed by this Court.

ORDER

Seeking to transfer the investigation in respect of Crime No.262 of 2022 dated 27.05.2022 from the file of the second respondent to the file of the third respondent, this criminal original petition is filed. 2.The learned counsel for the petitioner submitted that his father, namely, Bose @ Thangamalayandi, was murdered on 26.05.2022. In this regard, a First information report in Crime No.262 of 2022 came to be registered by the second respondent police for the offence under 2/6

Section 174 of Cr.P.C. However, there is no progress in the investigation and hence, this petition.

3.The learned Government Advocate (Criminal Side), appearing for the respondent State, on instructions, submitted that further action in the case had already been dropped for the reason that the deceased, who was the petitioner's father, while in a drunken state, fell down and died after dashing against a wall. The post-mortem certificate also reveals that the cause of death was head injury and liver disease. The complaint was registered at the instance of the Village Administrative Officer, who is the fourth respondent herein. The petitioner had never come forward to lodge any complaint, and now, after a lapse of three years, has approached this Court with the present petition claiming that his father was murdered.

4.Heard the learned counsel on either side and carefully perused the materials available on record.

5.Considering the submissions made, having slept over the matter for three years, the petitioner has now come forward with the present petition claiming that his father was murdered. It is also seen that the petitioner submitted a representation to the Superintendent of Police on 20.03.2025 in this regard. In view of the same, this Court does not find any merit in the petitioner's claim Accordingly, this Criminal Original Petition is dismissed.
