ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 3, in Crime No.147 of 2015 on the file of the respondent police, were arrested on 21.06.2015 for the alleged offences punishable under Sections 394, 397 @ 395 and 397 of I.P.C., and hence, seek bail.
2. According to the de-facto complainant viz., R.Senthil Kumar, on 17.06.2015, he along with one Kalaivanan and Surya have taken egg of 1,71,000/- for sales and after selling the egg, they were returning on 19.06.2015 with the sale proceeds of Rs.4,20,000/- and at 11.00 p.m., the accused with knife and aruval attacked the de-facto complainant and other and taken away the entire amount.
3. The learned counsel for the petitioners submitted that the https://hcservices.ecourts.gov.in/hcservices/ petitioners' names are not referred in the F.I.R. and in fact, the first accused, who was working as a load man, was also attacked by
the other accused and he sustained injuries. It is further submitted that they have been falsely implicated in this case.
4. The learned Government Advocate (Crl.side) submitted that the accused have no bad antecedent and the amount of Rs.4,00,100/- out of Rs.4,20,000/- was recovered from the accused and the major part of the investigation is over.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Manaparai and on further condition that the petitioners shall reside at Tuticorin and report before the Muthayapuram Police Station daily twice at 10.00 a.m. and 5.00 p.m. until further orders. sd/- 04/08/2015 / TRUE COPY / Sub-Assistant Registrar TO 1 THE JUDICIAL MAGISTRATE, MANAPARAI.
