ORDER

Though the respondent has been served through Court and the counsel has entered appearance for him, none appears when the case is called for hearing.

2. The petitioner seeks transfer of H.M.O.P.No.159 of 2019 pending on the file of the Sub Court, Virudhunagar, to the Sub Court, Kovilpatti.

3. The transfer is sought for mainly on the ground of convenience. Though the distance between two places, namely, Virudhunagar and Kovilpatti is not much, considering the fact that the petitioner lives in a village, namely, Mudhalipatti, Ettayapuram, Thoothukudi District and also considering her convenience, I am of the opinion that H.M.O.P.No.159 of 2019 be withdrawn from the file of the Sub Court, Virudhunagar and transferred to the Sub Court, Kovilpatti.

4. The inconvenience caused to her husband is minimal as the proceedings are before the Sub Court, where the presence of the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Tr.C.M.P.(MD)No.41 of 2021 parties for every hearing is not required.

5. Accordingly, the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.159 of 2019 is withdrawn from the file of the Sub Court, Virudhunagar and transferred to the Sub Court, Kovilpatti. No costs. Consequently, connected miscellaneous petition is closed.
