Prayer : Criminal Original Petition filed under Section 528 of BNSS, to call for the records relating to Crime No.118 of 2018 dated 14.06.2018 on the file of the 1st respondent Police and to quash the same insofar as the petitioner is concerned.

ORDER

The petitioners are accused Nos.1 and 2 in Crime No.118 of 2018 registered on the file of the respondent Police for the offence under Sections 147, 341, 352, 506(ii) and 392 IPC. They moved this petition to quash the case in Crime No.118 of 2018 registered against them, on the ground of compromise.

2. When this petition is taken up for hearing, the learned Government Advocate (Crl. Side) submits that the case in Crime No.118 of 2018 has been registered as against the petitioners. During the investigation, they found that two more persons are also involved in the commission of offence. Now, the investigation in Crime No.118 of 2018 was completed and the final report has been filed as against four persons including the petitioner for the offence under Sections 341, 352, 506(2) and 392 IPC before the learned Judicial Magistrate, Alangudi.

3. Since the investigation was completed and the final report has also been filed as against the petitioners and two others, this Court is not inclined to proceed with the available FIR. Therefore, this Criminal Original Petition 2/4

is closed with liberty to the petitioners to challenge the final report in the manner known to law. Mere filing of the final report is not sufficient. The respondent shall also ensure that the final report is in order and it is taken on file without any delay.
