Heard the learned counsel on either side.

2. The petitioner seeks issuance of passport. His application however has not been processed in view of the involvement of the petitioner in criminal cases.

3. It is clarified by the learned Additional Government Pleader appearing for R2 that both the cases are still at the pre-cognizance stage. Since the jurisdictional criminal court has not taken cognizance of the case, there cannot be any impediment for considering the petitioner's application.

4. The first respondent is directed to process the petition mentioned application and issue passport to the petitioner subject to fulfilment of usual formalities.

5. The Writ Petition is allowed. No costs.
