(MD) No. 7546/2019 in Crl.A(MD) No. 376/2009. Prayer in CRL A(MD). 376/ 2019 :

To admit the appeal call for the records set aside the conviction and sentence passed against the appellant in the judgment dated 20.08.2019 passed by the learned Special Court for the trial of Prevention of Corruption Act Cases, Madurai in Special case No.43 of 2011 and acquit the Appellant.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.BABU JAGANTH.R., Advocate for the petitioner and of Mr.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- This petition is filed to direct the trial court (the Special Court for trial of Prevention of corruption Act cases, Madurai) to allow the petitioner to comply with the condition imposed on him as per orders in Crl.M.P(MD) No. 7546 of 2019 in Crl.A(MD) No. 376 of 2019, dated 27.08.2019.

The learned counsel for the petitioner would submit that the petitioner is aged about 74 years, this Court vide order dated 27.08.2019 in Crl.M.P(MD) No. 7546 of 2019 in Crl.A(MD) No. 376 of 2019, suspended the sentence, by imposing a condition that the petitioner should appear before the trial Court on the first working day of every month at 10.30 a.m. He would further submit that the petitioner was regularly abiding with the condition and appear before the trial Court till 1.10.2021, but due to the sudden demise of the petitioner's son on 29.10.2021, he was not able to appear before the trial court on 01.11.2021. Hence he come up with the aforesaid prayer.

3.Considering the age of the petitioner, the condition imposed by this court in Crl.M.P(MD) No. 7546 of 2019 in Crl.A(MD) No. 376 of 2019, dated 27.08.2019 is modified and the petitioner shall appear before the trial court once in two months at 10.30 a.m., until further orders.
