ORDER

This Writ Petition has been filed to direct the respondents 1 and 2 to give adequate police protection to the petitioner and her husband and her family members for their life and liberty from the respondents 3 to 5 and their men within the time frame fixed by this Court

2. The petitioner has sent a representation to the Inspector of Police Thiruppalaikudi Police Station on 02.02.2024 seeking protection for his aged old parents, brother and property against the continuous assault made by Rajeswaran, Indra and Naveena.

The contention of the petitioner is that there were suits in O.S.No.105 of 2016 and O.S.No.37 of 2018 with regard to dispute of the property and the said suits are decreed in favour of the petitioner on 06.01.2024 and no appeal has been filed. On the other hand the said persons namely Rajeshwaran and others are causing damage to the property continuously by pelting stones and attacking the parents of the 2/6

petitioner and threatening them. There have been earlier complaint and eight First Information Reports have been registered and it is a routine way to call them, register First Information Report and let them out on station bail. No Charge sheet has been filed in this case, which embolden the accused to continue their assault and attack.

4. The learned Additional Public Prosecutor submitted that there is a property dispute with regard to survey No.210-1A. Further the Inspector of Police, Thiruppalaikudi Police Station had written to Tahsildhar, R.S.Mangalam to provide details. The police is also aware that there is a civil court order in favour of the petitioner. Further against Rajeswaran and other cases in Crime Nos.174/14, 115/19, 108/21, 58/22, 135/22, 85/23,128/23,187/24 have been registered they would be sufficiently warned. Once the report is received from the Tahsildhar appropriate steps would be taken.

5. It is seen that from the year 2014 the said Rajeswaran and others are continuously harassing the age old parents of the petitioner who are 3/6

senior citizen who are now seeking protection for their life and property. The police report shows that there have been eight First Information Reports have been registered but all the cases are at the stage of First Information Report and nothing more.

In view of the same, the Inspector of Police, Thiruapalaikudi is directed to transfer all the First Information Reports in Crime Nos. 174/14, 115/19, 108/21, 58/22, 135/22, 85/23,128/23,187/24 to the file of the Deputy Superintendent of Police, Thiruvadanai who shall take up investigation in all the cases and file final report and also ensure protection and take appropriate action against the offenders.

7. With the above direction the Writ Petition stands disposed of. No costs.
