ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. T.R.SUBRAMANIAN, Advocate for the petitioner and of MR.P.THIYAGARAJAN Advocate for the Respondent the court made the following order:- This Civil Miscellaneous Petition has been filed seeking withdrawal of arrears of monthly rent of Rs.1,04,000/-(Rupees One Lakh Four Thousand Only) out of Rs.1,25,000/- (Rupees One Lakh and Twenty Five Thousand Only) deposited to the credit of E.P.No.63 of 2014 in R.C.O.P.No.6 of 2013 on the file of the District Munsif Court, Theni.
2. Considering the rival submissions, this Court would allow this petition. The petitioner is permitted to withdraw the amount as prayed for without prejudice to any of the contentions of the respondent in the main execution petition.
