PRAYER :- For Bail in Crime No.1015 of 2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 14.12.2022 for the offence under Sections 451, 342, 392 and 397 IPC in Crime No.1015 of 2022 on the file of the respondent police, seeks bail.
2.The case of the prosecution, as per the de-facto complainant, is that she is residing at door No.25, Sundar Nagar 7th Cross Street, K.K.Nagar, Trichy and that on 18.10.2022, the person aged about 45 years claiming himself to be one Rajesh, had come to her house in the guise of taking the upstairs portion for rent and she had allowed him inside and the accused, after coming into the house, had threatened her with a knife and had robbed six sovereigns https://www.mhc.tn.gov.in/judis
of gold chain and two bangles from her and pushed her into the room and locked the room and escaped from the scene of occurrence. Hence, the case came to be registered.
3.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that this is the petitioner's second application for bail and the earlier application was dismissed by this Court, vide order dated 22.12.2022 in Crl.O.P. (MD)No.22801 of 2022 on the ground that the petitioner is a habitual offender, against whom, there are three similar cases of property offence and hence, he would oppose for grant of bail. 4.Taking into consideration the fact that there is no change in circumstances, since the dismissal of the earlier petition, this Court is not inclined to grant bail to the petitioner. 5.Accordingly, this Criminal Original Petition is dismissed.
