ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners, the learned counsel appearing for the intervener and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioners apprehending arrest at the hands of the respondent police for the offences under sections 147, 294(b), 323 and 506(i) of I.P.C., in Crime No.4 of 2020 on the file of the respondent police, seek anticipatory bail.
3. The primary allegations are only against the first petitioner. The first petitioner is said to be having one previous case. He is said to have attacked the police man and also got arrested. It is seen that no major injury was caused any of the victims. Therefore, I am inclined to grant anticipatory bail to all https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.868 of 2020 the petitioners herein. But then the first petitioner has to be put on terms.
4. Therefore, even while granting anticipatory bail to the petitioners, the first is restrained from entering the taluk limits of Manmangalam for a period of two weeks. The first petitioner will stay at Karur District and report before the Town Police Station, Karur District daily at 10.30 a.m. for a period of two weeks.
5. Subject to these conditions, I am inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.II, Karur, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner shall appear before Town Police Station, Karur daily at 10.30 a.m., for a period of two weeks and thereafter appear before the respondent police as and when required for interrogation. The petitioners 2 to 5 shall appear before the respondent police as and when reequired. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
