Respondent Prayer: This Criminal Original petition is filed under Section 482 of Code of Criminal Procedure, to direct the respondent to register a case on the basis of the petitioner's complaint dated 29.11.2017 for offences under Sections 406 and 420 of IPC within the time framed by this Court.

O R D E R

This petition has been filed to direct the respondent to register a case, based upon the complaint given by the petitioner, dated 29.11.2017.

2. The learned counsel appearing for the petitioner has submitted that the petitioner has purchased the property measuring about 29 Cents from one Paul Pillai and subsequently, it was found that already he has shown the said property as collateral security in the Tamil Nadu Mercantile Bank, Nagercoil and hence, a complaint has been lodged on 29.11.2017, before the respondent, but, so far, no action has been taken.

3. The learned Government Advocate (Crl. Side) appearing for the respondent has submitted that after receipt of the complaint enquiry has been started and after completing the enquiry, proper action will be taken.

4. Considering the aforesaid submissions, the respondent

is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then, he has register a case and proceed in accordance with law.

5. With the above observations, the Criminal Original Petition is disposed of.
