Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 3 apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 143, 294(b), 452, 424 and 506(i) of I.P.C. in Crime No.440 of 2015 on the file of the respondent police and hence, seek anticipatory bail.

2. According to the prosecution, on 31.01.2014, the accused have trespassed into the house of the de-facto complainant and damaged the compound wall.

3. The learned counsel for the petitioners submitted that the accused and the defacto complainant are neighbours and in respect of a dispute, a civil suit in O.S.No.415 of 2015 is pending before the District Munsif Court, Padmanabhapuram, it is further submitted that the petitioners are innocent and they have been falsely implicated in this case with an ulterior motive.

5. Considering the submissions made by the learned Government Advocate(Crl.Side), this Court is inclined to grant anticipatory bail to

the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate, Padmanabhapuram and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
