Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Mandamus directing the 3rd respondent to allot pathway to the petitioners temple namely Sri Ramapiran and Karuppasamy Temply situated in S.No.217/2 at B. Meenakshipuram Village, Bodinayakanur Taluk, Theni District through the government poromboke land situated in S.No.217/1 as per recommendation of the 4th respondent dated 06.05.2015.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.RAHUL, Advocate for the petitioner and of M/S.V.R.SHANMUGANANTHAN, Special Government Pleader for R2 TO 5 and MR.T.SARAVANAPANDIAN, for R4 the court made the following order:- [Order of the Court was made by R.SUBBIAH, J.] This petition seeking to condone the delay of 216 days in filing the appeal is allowed and the delay is condoned, on condition that the petitioner shall pay a sum of Rs.1,500/- [Rupees One Thousand and Five Hundred only], on or before 09.02.2017, to the credit of Creche Account, Women Lawyers' Association, Madurai Bench. It is made clear that if the cost is not paid by the petitioner, within the time stipulated in this order, the present Miscellaneous Petition shall stand dismissed automatically without any further reference to this Court.
