ORDER

This Criminal Original Petition is filed to call for the records pertaining to the impugned order in CC No.50/2020 on the file of the Judicial Magistrate-II, Virudhunagar and quash the same as far as the petitioner is concerned.

2. When the case was taken up for hearing earlier, a report was called for from the learned Judicial Magistrate No.II, Virudhunagar, as to whether any discharge petition is filed by the petitioner. A report is received from the trial Court stating that a petition in Crl.M.P.No.4285 of 2020 is pending before the Court without any progress.

3. In view of the above submission, pending discharge petition, this petition is filed seeking quashment of the proceedings. Let the petitioner prosecute the discharge application before the concerned Court. There shall be a direction to the trial Court to expedite the process and dispose of the discharge petition within a period of one month from the date of receipt of a copy of this order.

4. Accordingly, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petitions are closed. 11.12.2023 NCC :
