O R D E R
This Writ Petition has been filed seeking a direction to the third respondent to consider the petitioner's representation dated 03.11.2025 and to forbear the respondents from entertaining any illegal or fraudulent acts by any third parties and from registering or sub-classifying the petitioner's properties till the disposal of the pending Court proceedings.
2. The learned counsel appearing for the petitioner would submit that the petitioner is the absolute owner of the subject properties, which are valuable lands situated adjacent to AIIMS, Madurai. It is submitted that the said properties have already been mortgaged to a Bank and the issues arising therefrom are presently pending before the Debts Recovery Tribunal, Madurai. While so, certain third parties are attempting to illegally subdivide, reclassify, and register the subject properties, which would seriously prejudice the rights of the petitioner. Hence, the petitioner made a representation dated 03.11.2025 seeking protection of his properties till the disposal of the pending Court cases. 2/6
3. The learned Government Advocate appearing for the respondents would submit that the petitioner's representation would be considered in accordance with law.
4. This Court has considered the submissions made on either side. It is not in dispute that the petitioner claims ownership over the subject properties and that the same are already mortgaged to the Bank, with proceedings pending before the Debts Recovery Tribunal on account of default in repayment. The apprehension of the petitioner is that third parties may attempt to subdivide, reclassify, or cause registration of documents in respect of the subject properties, taking advantage of the increased commercial value owing to the proximity of AIIMS, Madurai. In such circumstances, the petitioner has made a representation dated 03.11.2025 seeking appropriate protection.
5. Considering the above facts and circumstances, this Court deems it appropriate to dispose of the writ petition with the following directions:

(i) The third respondent is directed to consider the petitioner's representation dated 03.11.2025 and ensure that if any document is presented for registration in respect of the subject property or its subdivision, the same shall be processed only after issuing notice to the petitioner, either in person or by Registered Post with Acknowledgment Due (RPAD), and after affording an opportunity of personal hearing to the petitioner.
(ii) As far as sub-classification of the subject property is concerned, the second respondent is directed to consider the petitioner's representation dated 03.11.2025, after affording an opportunity of personal hearing to the petitioner, and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
6. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
