Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to pass order based on the application submitted by the petitioner dated 02.12.2002 for the sanction and disbursement of capital subsidy for the expansion unit of the petitioner together with interest at 18% from 02.12.2002 to till the date of payment is made.

ORDER

This Writ Petition is filed for Mandamus directing the respondents to grant capital subsidy to the petitioner.

2. The respondents have filed a counter stating that the petitioner's application dated 02.12.2002 was already rejected vide order dated 16.02.2005. The petitioner submitted that the order dated 16.02.2005 was not served on him.

3. Therefore, this Court directing the respondents to serve the aforesaid order. The petitioner is granted liberty to challenge the said order.

4. With the above direction, this Writ Petition stands dismissed. There shall be no order as to costs.
