O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in NO.RO.TRY/645/2025-CA dated 07.01.2023 and direct the first respondent to grant 40 days ordinary leave withour police escort to the petitioner's son namely Doss @ Vattakkan @ Perumal @ Pethaperumal , S/o. Perumal aged about 37 years, Life convict bearing Convict Prisoner No. 23331, PID No.34432 confined at Central Prison, Trichy

2. It is the case of the petitioner that his son was convicted by the learned I Additional Sessions Judge, Tirunelveli in S.C. No.296 of 2010 on

29.07.2011 and sentenced to undergo life imprisonment for the offence under Section 302 of IPC. Aggrieved over the same, the convict has filed an appeal before this Court in Crl.A(MD) No.301 of 2011 and the same was confirmed by this Court on 21.11.2012, against which the convict has also preferred an appeal before the Hon'ble Supreme Court and the same was also dismissed. The petitioner submitted an application seeking ordinary leave for a period of 40 days. After considering the request made by the petitioner, the first respondent has granted 40 days ordinary leave to the petitioner's son with escort. The petitioner being a poor person, could not afford the cost of escort.

3. In view of the above, the condition imposed in the order dated 07.01.2026 directing the convict to go on ordinary leave with escort is modified and he shall go on ordinary leave without escort. However, the convict is directed to comply with the usual conditions imposed by the jail authorities and he should also report before the fourth respondent police daily at 05.30 p.m. He shall duly comply with the conditions and return to the prison on expiry of the leave period.

4. Accordingly, the order of the first respondent dated 07.01.2026 is quashed in sofar as the ordering escort alone and the Writ Petition is disposed of.
