ORDER

This Petition has been filed to direct the first respondent to register a case based on the complaint given by the petitioner dated 02.01.2018.

2.The learned counsel for the petitioner has submitted that on 27.12.2017, the proposed accused persons attacked the petitioner with iron rod and also criminally intimidated him and hence the complaint was given before the first respondent on 02.01.2018, but so far no action has been taken.

3.The learned Government Advocate (Crl.Side) has submitted that after receipt of the complaint, CSR has been issued and petitioner was called upon for enquiry, but he did not appear and hence the first respondent is not able to proceed further. https://hcservices.ecourts.gov.in/hcservices/

4.Considering the aforesaid submissions, the petitioner is directed to appear before the first respondent on 30.01.2018. The first respondent has to enquire the matter and if the enquiry reveals any cognizable offence is made out, he has to register the case and proceed in accordance with law.

5.In case the petitioner is not appeared before the first respondent for enquiry, on that date, then it is open to the first respondent to drop further proceedings.

6.With the above observations, this Criminal Original Petition is disposed of.
