ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 120(b), 366, 342, 376 r/w. 109 of I.P.C., in Crime No.112 of 2011 on the file of the respondent police, in pursuance to the nonbailable warrant issued by the Mahila Court, Tuticorin on 28.04.2012 and hence, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that the petitioner was arrested and released on bail during investigation and he also appeared before the Judicial Magistrate at the time of committal of the case to the Sessions Court and it is further submitted that he has gone to Kerala for his livelihood and therefore, he could not appear before the trial Court.

3. Considering the fact that the petitioner has involved in the offence of 376 I.P.C., this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition is dismissed. However, if the petitioner surrender before the trial Court and file an application for bail, it can be considered on merits and in accordance with law.
