ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 5(n), 5(1), 1/4

5(j)(ii) read with 6(1) of POCSO Act and 351(3) of BNS Act, seeks anticipatory bail.

2. The case of the prosecution is that on false promise the petitioner had sexually assaulted the minor victim girl. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side)opposed for grant of anticipatory bail to the petitioner on the ground that the petitioner is cousin of the minor victim girl and it is made clear from the 164(1) Cr.P.C. statement the petitioner had sexually assaulted the minor victim girl. The respondent police has completed investigation and final report is made ready.

5. By taking all these reasons into consideration, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
