ORDER

The petitioner, who was arrested on 21.08.2023 and remanded to judicial custody for the offences under Sections 457, 380 IPC, 379 IPC, 8(c), 20(b)(ii)(A) of 1/4

NDPS Act, 454 and 380 IPC, 392 IPC and 379 IPC respectively in Crime Nos.357, 380, 426, 345, 205 and 19 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case. He further submitted that the petitioner has been in jail from 21.08.2023 and the petitioner's mother passed away today, ie., 11.01.2024 and the petitioner being one of the son has to perform the final rites. Hence, he prays to grant bail to the petitioner.

3. The learned Additional Public Prosecutor appearing for the respondent submits that there are five previous cases pending against the petitioner under various offences. However, on instructions, he fairly concedes that the mother of the petitioner passed away on 11.01.2024.

4. Considering the fact that the final rites of the petitioner's mother is to be held on 12.01.2024, this Court is inclined to grant Interim Bail to the petitioner. Accordingly, the accused Selvakumar @ Anda Selvakumar in Crime Nos. 357, 380, 345, 426, 205 and 19 of 2023 is hereby directed to be released on Interim Bail for a period of two days starting at 6.00 p.m. on 11.01.2024 till 5.00 p.m. on 13.01.2024 and the accused shall surrender before the respondent police at 5.00 p.m. On 13.01.2024 and he shall be produced before the trial court by the respondent police on the same day.

5. During the period the petitioner is on bail, he shall be escorted by a police constable, the expenses towards the same to be borne by the petitioner.
