PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to remove/relocate the Liquor Shop namely Shri Abhirami Bhavan functioning in the Kannanur -Samayapuram four-lane road, situated near Arulmigu Mariamman Higher Secondary School, K.Ramakrishnan Engineering College, and temple, S.Kannanur Panchayat, Manachanallur Taluk, Trichy District, based on the petitioner's representation dated 23.09.2025 within time frame fixed by this Court. ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) The instant writ petition has been filed seeking a direction to the respondents to remove/relocate the Liquor Shop namely Shri Abhirami Bhavan functioning in the Kannanur -Samayapuram four-lane road, situated near Arulmigu Mariamman Higher Secondary School, K.Ramakrishnan Engineering College, and temple, S.Kannanur Panchayat, Manachanallur Taluk, Trichy District, based on the petitioner's representation dated 23.09.2025. 2.According to the writ petitioner, the petitioner has filed the present writ petition mainly on the ground that the TASMAC shop is 2/5
causing nuisance to the public and his representation submitted in this regard has not been considered sofar.
3.It is brought to the notice of this Court that the necessary license has been issued to the shop by the authorities concerned vide proceedings dated 31.07.2025. Once a licence has been granted by the authority competent under the relevant statutory Rules, no mandamus as sought for by the petitioner can be issued to the petitioner in exercise of its jurisdiction under Article 226 of the Constitution of India. Insofar as the grievance regarding nuisance is concerned, it is always open to the petitioner to work out his remedy before the appropriate authority in the manner known to law.
