[Order of the Court was made by M.DURAISWAMY,J.] The petitioner has filed the above writ petition to issue a writ of mandamus directing the first respondent - Debt Recovery Tribunal, Madurai, to dispose of S.A.No.505/2019 filed by the second respondent within a time frame.

2. The learned Counsel appearing for the petitioner submitted that the Debt Recovery Tribunal, Madurai had posted the SARFAESI Appeal to 03-June-2020 and that the second respondent is ready and willing to make substantial payment towards the loan account. In these circumstances, the learned Counsel submitted that the Debt Recovery Tribunal, Madurai, may be directed to dispose of the SARFAESI appeal within a time frame.

3. Having regard to the submissions made by the learned Counsel appearing for the petitioner, taking into consideration the limited prayer sought for in the writ petition, without expressing any opinion with regard to the merits of the case, we direct the first respondent to dispose of the SARFAESI appeal in S.A.No.505 of 2019 on merits and in accordance with law within a period of five months from 03-June-2020.

4. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
