Prayer in CRP(MD). 2540/ 2023 :

To set aside the fair and decreetal order made in I.A.No.1 of 2023 in H.M.O.P.No.236 of 2021 dated 25.07.2023 on the file of the Learned subordinate Judge, Thirumangalam.

ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.M.VIVEK KUMAR, Advocate for the petitioner and of MR.K.JAGADEESAN, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed to permit the petitioner/respondent to withdraw the arrears of maintenance amount deposited in the credit of H.M.O.P.No.236 of 2021 on the file learned Subordinate Judge, Tirumangalam, for the present. 2.Being satisfied with the reasons mentioned in the affidavit filed in support of this petition. CMP(MD) No.496 of 2024 was deposited by the respondent on the file of the learned Subordinate Judge, Tirumangalam, which is available in the credit as on date. It is stated that a total sum of Rs.56,000/- is available in the credit. The learned counsel for the respondent would submit that the respondent has no objection for the same.
