ORDER : The Court made the following order :- 1/4

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 329(3) and 326 of BNS 2023, in Crime No.637 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to property dispute, the petitioner along with other accused persons have trespassed into the defacto complainant's house and set fire on the two wheeler of the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. side) submitted that the specific overtact against the 2/4

petitioner is that he put fire on the defacto complainant's bike. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and considering the seriousness of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 03.02.2026 PJL TO 1.The Inspector of Police, Eraniel Police Station, Kanniyakumari District.
