2.By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

3.The learned Counsel for the petitioners would submit that the subject property originally belonged to the petitioners' grandparents and after the demise of the petitioners' grandfather, the property devolved upon his legal heirs. Among the legal heirs, one of the legal heir Pushpa died issueless. The other legal heirs decided to sell their undivided shares to the petitioners and they presented the sale deed before the second respondent, which came to be refused citing the reason that the legal heirs of deceased Pushpa were not included. Hence, the present Writ Petition. 2/6

4.Learned Counsel for the petitioners, referring to the legal heirship certificate of one Pushpa submits that the said Pushpa and her husband died issueless and therefore, as on date, there are only five legal heirs and prays for setting aside the impugned orders. 5.Learned Special Government Pleader appearing for the respondent would fairly admit the fact that the there are only five legal heirs as on date and prays to set aside the impugned order and remand the matter to the respondent for fresh consideration. 6.Heard the learned Counsel on either side.

7.Admittedly, in the present case, there are only five legal heirs since one legal heir Pushpa and her husband died issueless. Therefore, there can be no impediment for the respondent in registering the sale deed presented by the petitioners. Therefore, the impugned orders dated 31.12.2025, passed by the respondent is set aside. While setting aside the impugned orders, this Court directs the respondent to register the sale deeds upon re-presentation of the same, with immediate effect. 3/6

8.Accordingly, these Writ Petitions stand disposed of. There shall be no order as to costs.
