The Criminal Original Petition has been filed under Section 482 of the Criminal Procedure Code, 1973, seeking a direction to the first Page No. 1 of 4
respondent and his subordinates not to harass the petitioner and to follow the due process of law based on the petitioner's representation dated 08.01.2025.
2. The learned counsel for the petitioner fairly submitted that the petitioner has been appearing before the police station twice daily, as per the conditional order. Each time, the petitioner has been made to wait at the police station for two hours before receiving acknowledgment. This delay is alleged to be for an ulterior motive, to harass the petitioner.
3. The learned Additional Public Prosecutor appearing for the respondents submitted that the condition of appearing before the second respondent, DCB, has been completed. The petitioner has several cases against him. Two FIRs have been filed against the petitioner before the second respondent, DCB, and additional FIRs have been filed before the Pavoorsathiram and Kadayam Police Stations. He further submitted that the petitioner has been making such allegations to cause action against the investigation officer. The petitioner need not wait at the police station. He further submitted that these allegations are made by the petitioner only for the purpose of creating a defense. The petitioner has not been detained for Page No. 2 of 4
long hours. He has only been questioned for the purpose of the investigation and then allowed to leave.
