Respondent PRAYER: Criminal Original Petition is filed under Section 439(1)(b) of the Code of Criminal Procedure, to modify the (ii) condition imposed in Cr.M.P.No.6955 of 2017 dated 02.01.2018 on the file of the Principal Sessions Judge, Madurai to the effect that the petitioner shall appear before the concerned Court instead of appearing before the Chengelpattu Police Station daily at 10.00 a.m and 06.00 p.m.

ORDER

This Criminal Original Petition has been filed to modify the condition No.(ii) imposed in Cr.M.P.No.6955 of 2017 dated 02.01.2018 on the file of the Principal Sessions Judge, Madurai to the effect that the petitioner shall appear before the concerned Court instead of appearing before the Chengelpattu Police Station daily at 10.00 a.m and 06.00 p.m.

2.The learned counsel appearing for the petitioner submitted that it is difficult for the petitioner to stay at Chengelpattu. Since he is a sole breadwinner of his family and he is working in Madurai. Moreover the petitioner is having duty to maintain his family, hence the condition imposed in Crl.M.P.No.6955 of 2017 may be modified to the effect that the petitioner shall appear before the concerned Court.

3.The learned Government Advocate (Crl.side) appearing for the respondent Police submitted that the petitioner complied with the condition from 13.01.2018 onwards.

4.Considering the facts and circumstance of the case and also considering the reasons stated in this petition, this Court is inclined to modify the condition No.(ii) imposed by the learned Principal Sessions Judge, Madurai, dated 02.01.2018 in Cr.M.P.No.6955 of 2017. Accordingly, the petitioner is directed to appear before the respondent Police daily at 10.00 a.m. until further orders.
