Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for an alleged offence punishable under Section 363(A) of IPC in Crime No.148 of 2015, seeks anticipatory bail.
2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl. side) appearing for the respondent.
3. According to the de facto complainant, one Palaniammal and some of the accused have kidnapped the minor children and used them for begging and committing theft, in other States.
4. The learned counsel for the petitioner submitted that except this petitioner, other accused were already arrested and released on bail. He further submitted that he met with an accident on 08.02.2015 and he is now bed ridden, due to the injuries sustained on the spinal cord.
5. The learned Government Advocate (Crl.Side) submitted that there is no previous against the petitioner. He further submitted that co-accused were already arrested and released on bail and the https://hcservices.ecourts.gov.in/hcservices/
children were also secured.
6. Considering the facts and circumstances of the case and also considering the fact that the co-accused have already released on bail, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No. VI, Trichy, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
