CRL OP(MD). No.883 of 2020 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 22/01/2020 PRESENT The Hon'ble Mr.Justice G.R.SWAMINATHAN CRL OP(MD). No.883 of 2020 Sethupathy @ Sethupandian ... Petitioner/Sole Accused Vs The State rep.by The Sub Inspector of Police, Ramanathapuram Bazaar Police Station, Ramanathapuram District.

Crime No.254 of 2019 ... Respondent/Complainant For Petitioner : M/s.S.Mahendrapathy, Advocate.

For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- for Bail in Crime No.254 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is in custody since 13.11.2019 for the offence punishable under section 302 of I.P.C., in Crime No.254 of 2019 on the file of the respondent police. He seeks bail.

3. On going through the FIR, it is seen that the petitioner was originally married to the deceased and that, even without formally dissolving the same, he got married to one Mariammal. The petitioner was employed Abroad and it appears that he had purchased the property in the name of his first wife/deceased. The petitioner insisted that the deceased should transfer the property to him, so that, he can sell the same and clear his debts. It appears that the deceased was not co-operating. That is said to be the motive for the occurrence. But then, the manner, in which, the crime has been https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.883 of 2020 committed is too brutal. The petitioner had repeatedly stabbed Jeyarani on the vital parts of the body and later, also slit her throat. The manner in which, the crime was committed, impels me to decline bail to the petitioner.

4.The learned Government Advocate (Crl.side) also states that final report is yet to be filed and investigation is still pending. 5.In view of the above, this criminal original petition stands dismissed.
