ORDER
The petitioner, who appointed as Clerk in the Nemam Primary Agricultural Cooperative Credit Society Ltd., in the year 1975, retired from service as Secretary of the Society, on 31.12.2008. The petitioner with a grievance that his terminal benefits has not been settled till date, has filed this writ petition claiming that a sum of Rs.2,76,726/- has to be paid by the respondents.
2.The learned counsel appearing for the petitioner submits that the respondents are supposed to pay a sum of Rs.3,71,726/- to the petitioner but, they have paid only a sum of Rs.95,000/- and balance amount of Rs.2,76,726/- is yet to be paid. He further submits that the petitioner is 75 years old and suffering from several ailments and not even in a position to meet out his medical expenses. 2/6
3.The learned Special Government Pleader appearing for the respondents 1 to 3, by referring to a proceedings dated 31.01.2026, submits that a sum of Rs.2,30,267/- has already been paid to the petitioner. Since the society is facing financial difficulties, they seek some accommodation to pay the balance amount of Rs.1,41,459/- due to the petitioner.
4.This Court has considered the submissions made on either side and perused the available materials in record. 5.The petitioner has served in the Society for more than 24 years and retired from service in the year 2008. Terminal benefits due to this petitioner has not been settled till date. A sum of Rs.95,000/- has alone been paid by the respondents and balance amount of Rs.2,76,726/- is yet to be paid. Therefore, the petitioner has filed a writ petition in WP. (MD)No.21284 of 2015 and this Court by its order dated 30.11.2015 has disposed the said writ petition with a direction to the respondents to pay the terminal benefits due to the petitioner, within a stipulated time with 9% interest. Even thereafter, the respondents have not paid the 3/6
amount as directed by this Court. Now, they have come up with a written instructions that a sum of Rs.2,30,267/- has already been paid. 6.This Court by its earlier order dated 30.11.2015 has already issued a direction to the respondents to pay the amount due to the petitioner together with interest at the rate of 9%. Therefore, the respondents are supposed to pay the balance amount due to the petitioner, within a period of three months from the date of receipt of a copy of this order. If the respondents fail to pay the amount, within the stipulated time, the petitioner is at liberty to file a contempt petition.
7.With the above direction, this writ petition is disposed of. There shall be no order as to costs.
